In the Federal Register, published on March 25, 1999, the U.S. Department
of Health And Human Services published a Notice of Proposed Rulemaking. The
Indian Health Service is proposing to establish regulations as mandated by
Section 408 of the Indian Child Protection and Family Violence Prevention
Act, that prescribe minimum standards of character and suitability of
employment criteria for individuals who are employed or are being
considered for employment  in positions with duties and responsibilities
that involve regular contact with or control over Indian children.

Th act and proposed rulemaking are far reaching because the tribes are
required to do background checks on affected individuals working in tribal
programs dealing with Indian children.
