The USA exrel James Stone vs Rockwell Int'l False Claims Rocky Flats Case
opening statements started on 2/22/99. The testimony primarily focused on
three key environmental crimes areas that were also focus areas of the USA vs
Rockwell FBI case from 1989. The CLOSING arguments are scheduled for this
coming Monday, March 29, 1999 at the Denver Federal Court house in Judge
Match's 2nd floor court room.

These charges included mismanagement of wastes such as "pondcrete, &
saltcrete" from the Solar Evaporation Ponds, Spray Irrigation of radiotoxic
wastes onto lands that sheeted off to US waters and travelled offsite to
public drinking water supplies, and Sewage Treatment Plant problems associated
with contamination, rad & chemical wastes, and biologically "killing" some of
the holding ponds at RF.

The list of witnesses include luminaries such as former DOE Secretary Admiral
James Watkins, who testified to DOE's indignation in Rockwell not running
Rocky Flats correctly. He testified about problems he was familiar with at
Savannah River, Chernobyl, Three Mile Island - and that when he got around to
looking at Rocky Flats, he couldn't believe the mess. One item leaving the
greatest impression on the Admiral was the problem of the accumulation of more
than 6 bombs - worth of Pu (plutonium) in the ducts at Rocky Flats to make 6
bombs. This still hasn't been resolved more than 10 (ten) years later. He is
currently working on preventing further ocean dumping of radioactive
contaminated materials.

...Speaking of the Wolpe Congressional investigation into what went wrong with
the ill-fated plea agreement on the USA vs Rockwell case, the following list
of witnesses in the Stone case reads like a who's who of names we could fill
in the blanks with, for the Congressional Record that came out of the Wolpe
deliberations. (The standard disclaimer of this statement being my opinion
applies here.) Of course, some of these names are just witnesses to what
happened at RF, and will be familiar to long time Rocky Flats activists: Earl
Whiteman, George Setlock, Gary Potter, Frank Blaha, Bill Weston, Bill Rask, Ed
Naiman, Bill Romatowski, Rick Gaskin, Delores Kreig; Long, Kelar, Fanner,
Sattler, Henry, Cypher, Tegler, Juarez, Swenson, Johnson, Schlag, Dnadinali,
McGuenhan, etc.

What you may have missed:

*There was an "anonymous" request to the Court of Apppeals to block attempts
to access records from the USA vs Rockwell Grand Jury to impeach witness
testimony.

*Reboxing of pondcrete and saltcrete waste blocks (recall: consistency of
mayonnaise, didn't set up, triwall cardboard boxes collapsing) went on well
into 1997, at a cost of over approximately $12 million taxpayer dollars.

*Some DOE/Rockwell representatives bragged about how much they did out there,
went all over the RF facility talking to people, inspecting, but never wrote
anything down. (sound familiar?)

*An angry letter from Rockwell plant manager Dominic Sanchini illustrated the
deep rift between Rockwell and DOE.

*Testimony regarding the spray irrigation (Clean Water Act violations that
Rockwell plead guilty to in 1991, was reported to FBI by EIN director Susan
Hurst in 1986) discussed massive runoff to Woman Creek that were enhanced by
tire tracks forming a ditch for the water to run down - this was known to
Rockwell, but was not reported to DOE. This water ran offsite to Standley
Lake, public drinking water supplies for the cities of Westminster,
Northglenn, and Thornton - northern suburbs of metro Denver.

Some of these Stone case witnesses had to be repeatedly reminded of previous
testimony when their memories seemed to flag a bit. Some of these were
witnesses were environmental managers, some were foreman and supervisors. It
should be noted that although Rocky Flats contractors have changed from DOW to
Rockwell to EG&G to Kaiser-Hill, the faces have remained the same. Some have
left the immediate employ of the main contractor with fat VSP's (volunteer
separation packages) to come back in through the revolving door as higher paid
consultants and subcontractors.
