Outspoken Alberta judge slams Indian policies
 WebPosted Fri Jan 15 04:45:07 1999

CALGARY - An outspoken provincial court judge disciplined for his
approach to aboriginal defendants has again come into
the public eye for
                     his forthrightness.

Judge John Reilly yesterday delivered a scathing
indictment of living
conditions on Alberta's Stoney Indian Reserve.

Reilly sentenced to one year a man who stabbed his
friend to death during
a drunken brawl. Only the law prevented him from
giving the accused six
months, Reilly said in his written decision.

Reilly said much of the reserve's violence has its
roots in residential
                     schools, unfair treaties and assimilation.

The defendant's lawyer, Willie Dewitt, said he can
understand why Reilly
is trying to push the limits of the law.

Reilly recently came under attack from Alberta's chief
judge when he
ordered a sweeping investigation of living conditions
on the reserve.

He has since been ordered relocated to Calgary, but
remains on the job in
rural Cochrane until a higher court rules on his
constitutional challenge
                     to the move.
