Subject: [buffalo-rescue] [Fwd: Montana Statute 81-2-120]

For some odd reason this message didn't get through in it's entirety so
here is a repost. (Hopefully)

There are a couple of things in this that I didn't know and perhaps they
should be pointed out to all.
.
        (c) the live wild buffalo or bison may be captured, tested,
quarantined, and vaccinated. Wild buffalo or bison that are certified
by the state veterinarian as brucellosis-free may be:
                (i) sold to help defray the costs that the department incurs
in
building, maintaining, and operating necessary facilities related to the
capture, testing, quarantine, or vaccination of the wild buffalo or
bison;

It looks to me that if they want they can kill any and all buffalo they
capture, regardless if they are free of disease or not. And this is
disturbing also:

(d) Proceeds from the sale of live, brucellosis-free, vaccinated
wild
buffalo or bison must be deposited in the state special revenue fund to
the credit of the department.
        (e) Any revenue generated in excess of the costs referred to in
subsection (1)(c)(i) must be deposited in the state special revenue fund
provided for in 87-1-513(2).

It looks like one hell of a way for the MDOL and the state of Montana to
make potentially a lot of money if the can slaughter the buffalo in numbers
of 1000 or more.

So there you have it, any wild buffalo that wanders on to state or private
land can be killed, regardless of whether it is diseased or not, and sold
by MDOL for a profit to itself and the state of Montana. Does anyone still
believe this is only about disease control? Also does anyone know if the
State has to make public the records of what happens to this money or does
it end up in some political slush fund for the benefit of a few crooked
politicians? (Like Gov. Racicot)

And then they have the nerve to wonder why Montana is looked down on by the
rest of the nation as the home for a bunch of kooks, militia nuts and white
supremacists. The answer why is simple: The state government of Montana is
"their kind of people".
