And now:Ish <[EMAIL PROTECTED]> writes: * From: Tom Kunesh <[EMAIL PROTECTED]> Jailed for Being a Witness ---------------------------------------------------------------- Yesterday (Friday, 9 July) Timothy Nauyokas, Lakota, age 36, living & working in Chattanooga for the past six years, was arraigned before Criminal Court Division 3 Judge Steve Bevil here in Chattanooga on two counts of first-degree murder: two dead homeless men whose murders Nauyokas witnessed and reported to the police. Nauyokas' attorney, Public Defender Karla Gothard, requested again that the charges be dismissed for lack of evidence as they had been twice before by other judges, the only evidence they have are the dead bodies and Nauyokas' eyewitness account. The District Attorney's office, however, stated that there was "new" evidence and they objected to the dismissal. In the judge's chambers and later in the courtroom the DA's attorney declined to state what the "new" evidence was. Public Defender Gothard again moved for dismissal; the judge denied it. Gothard then asked for a speedy trial, since there was no apparent available evidence on which to keep Nauyokas locked up. Agreeing, the judge set the trial date for Tuesday, 14 September - more than two months away. All done in five minutes of talking. After Nauyokas was led away in chains back to jail, I had a private talk with Public Defender Gothard during which she told me that she thought the DA's office wants to continue holding Nauyokas as the only material witness in hopes that they'll soon catch the actual killer, a homeless Georgia man, Elton Travis Wager, also known as Jed Stevens, and want to be able to use Nauyokas' live testimony. Since Nauyokas has no family anywhere near this area, the DA's office is probably concerned that after their smear campaign against him in the press and television here, he'll leave town and never come back, and they'll be out their only witness. So, until something else happens, Timothy Nauyokas will be sitting in Hamilton County jail (http://www.hamiltontn.gov/Sheriff/jail/jail.htm) for the next nine weeks with nothing to do, waiting for a trial that probably won't happen. worse, there was an attempted jail break last week on his floor. When he gets out in a couple of months, he'll need clothes: a) pants/jeans 36/38"w x 31"l b) shirts XL 40-44 c) workboots size 9.5-10 I'd like to let him know this Wednesday when I visit him that there's a living, strong Native community in this state that does care about its own living in jails & prisons.
