State Officials Stick To Guns In Santee Sioux Casino Fight

OMAHA, Neb. (AP) -- Nebraska officials are sticking to their guns in the latest 
chapter of the state's fight with Santee Sioux tribal leaders over the tribe's Ohiya 
Casino.

Gov. Mike Johanns and Attorney General Don Stenberg filed a joint 38-page response 
Friday to U.S. Interior Secretary Bruce Babbitt asking that his department not 
intervene in the tribe's effort to have its northeast Nebraska casino win legal 
approval to operate.

In May, the tribe applied for a compact through the Interior Department. Under new 
procedures allowed by the Interior Secretary, tribes can negotiate compacts with the 
federal agency when states have been reluctant to talk with the tribes.

Friday's response reiterated the state's long-standing position that it is bound by 
the state constitution, which prohibits casino gambling. Although Congress passed a 
law 11 years ago allowing tribes to negotiate gaming compacts with states, Nebraska 
officials argue the state can only compact with tribes on gambling ventures that are 
already legal in the state.

The tribe opened the Ohiya Casino in February 1996, the same day filing a lawsuit 
against the state. The tribe claimed the state refused to negotiate a gaming compact 
in good faith.

The Tribal Council continues to face a $6,000-per-day fine for refusing a federal 
judge's order to close the casino. Last month, the same judge dismissed a civil 
contempt of court action filed against the council.

In that ruling, U.S. District Judge William Cambridge conceded that the council is 
bound by an Aug. 3 referendum election in which tribal members voted 61-11 in support 
of keeping the casino open.
