Shane Gottfriedson

August 14, 2013
An angry news release sent out in June seems to have boosted the Tk'emlups
Indian Band's profile with Kinder Morgan.
Chief Shane Gottfriedson denounced the company last June with accusations that
it used deceit to gain an easement permit through traditional territories for
its pipeline twinning project.
Now the two sides are now working through their issues, he said.
"They were talking (with us) but they weren't really taking the issue
seriously," said Gottfriedson. "Now they are taking the issue very seriously."
After meeting with other affected First Nations leaders last June, Gottfriedson
said Kinder Morgan's plans amounted to trespassing.
"Without Kinder Morgan applying for a permit on our reserve, we will be forced
to go to court," he said at the time.
The problem, said First Nations leaders, was that easement permits previously
allowing access to the affected properties were never transferred to Kinder
Morgan.
"And the original corporation that was granted the permits by the government no
longer exists," stated a TIB press release.
Band leaders say they were told the permits were held in trust by Terasen Gas,
now FortisBC.
They could find no document trail or approval by Indian Affairs or the B.C.
Utilities Commission.
"The Kinder Morgan people made this trust up so that they don't have to apply
for a proper permit for their pipelines on our Kamloops IR#4," said
Gottfriedson. "In the scheme of things, it would cost them little to rectify
this. A new permit would contain environmental safety standards. The old ones
don't."
Nearly two months later, Gottfriedson sounded much less frustrated but he was
unwilling to say what his band wants.
"I'm not going to disclose publicly what we want," he said. "We're in detailed
negotiations discussing a number of outstanding issues in relation to the
pipeline that's impacting Tk'emlups traditional territory."
