Yes, but they are talking STOCK products pictures.   Not user  pictures 
(read on).
 
So, if you are selling an HP Server, printer, they use the manufacturer  
stock photo (and added description if you use a part number.)
 
If they specifically use your photo (happened to a friend), they notify you 
 AND you get free listings.  My business is almost all eBay related and 
they  have never used my photo (that I am aware of).   Heh, I wouldn't mind  
getting free listings even if it is only the subtitle.  (Free advertising  is 
also good and they show your user id on the photo which is even more free  
advertising.
 
Read about Vero.  It's the best way to prevent people from using your  
photos/description.
