On a Linux/*NIX system you can run any/one of the following:
(Some require root privileges...)

* netstat -anp |grep 1241
* lsof -i tcp:1241
* fuser 1241/tcp

The netstat command just shows that TCP is listening to that port. It does not show 
who is the owner.

Is there another way to find out if the nessus daemon is running besides trying to 
invoke the daemon with a bind fail error.

"nessusd -D" is the command to put the Nessus server into daemon mode
(ie. start the server).

Are you trying to launch the client or the server? If you are launching
the server,. what does "netstat -an | grep 1241" show?
