Nessus is available in two "flavours": 2.x, which is subject to the GPL, and 3.x, which, while not open-source, is still available for free and offers significant performance improvements. See <http://www.nessus.org/documentation/index.php?doc=nessus3> for a comparision of the two.

As for plugins, you can choose from either the direct feed, which consists of all plugins in real time; the registered feed, which delays plugins that Tenable writes for new flaws by 7 days; and the GPL feed, which contains only plugins written by third-parties. Of the three, only the direct feed has a fee associated with it (US$ 1200 per scanner per year).
