You cannot compile for other FreeBSD versions than the one you're running (well, obviously, you'll get away with it on many occasions but if you don't you're entirely on your own).


Why not just compile on FreeBSD 4.9?

If you really, really, want to see how far you can stretch your luck, there are options, but you're really likely to shoot yourself in the foot.
