Hi all

Apologies for yet another posting on the Y2K NC2 MDII issue, but I
have contacted Trading Standards in the UK concerning this issue.

They were completely in agreement that registered NC2 users are
entitled to a free MDII Y2K patch. To summarise their main points:

1) Software sold must be fit for the purpose - Netconnect 2 in their
opinion was not fit for its purpose as Microdot II would fail Y2K
complience.

2) If a piece of software is not fit for its purpose one of 2 things
must happen:

a) A majority refund of the cost of the software must occur (minus an
amount to cover the time when the software worked OK - ie up to and
including 31/12/1999)

or
b) a fix for the software must be forthcoming in a reasonable
timescale (in this case we are talking about the Y2K fix). If the fix
is not forthcoming in a reasonable timescale (we are into that already
as Y2K is here) then point "a" above applies. However in fairness to
Active Technologies, if a bug fix is forthcoming in the next month to
two months (as long as they tell us now) I'm happy.

3) Software sold within a couple of years of Y2K that is not Y2K
complient is to quote Trading Standards "Not of satisfactory quality"
and a refund/fix as in points "a" or "b" above applies.

4) As Active Technologies stated in their adverts in Amiga Format
words to the effect of "Bug fixes will be free" and people bought the
software partially as a result then Active Technologies are legally
obliged to provide a fix or refund (in this case it would most likely
be a full refund).

Again I am sending a copy of this to Chris @ Ative Technologies and to
Ben Vost Editor of Amiga Format as this contains information prevalent
to the situation which I am sure both will be interested in.

I also telephoned Ben Vost of Amiga Format today and discussed the
situation with him. To avoid prejudicing any outcomes that this may
all have I'm not stating what the exact contents of the discussion
were. However I will state that I was encouraged by Ben's response and
I believe all those that have access to Amiga Format should buy it
over the next few months as there may be something of relevance to
this situation. Thank you for patiently listening to me Ben!

My final point in this long email. I do not believe that NC2 users
should receive a free update to NC3 as has been suggested by "someone"
who will remain nameless. I believe that NC2 users should be given a
free Y2K fix for Microdot II, nothing more and nothing less.

hearing the response of Amiga Format to this issue and to a response
from Active Technologies.

Yes this email client is NOT Y2K complient - blame it on no update for
Netconnect2 (and �30 for the update when I just want to fix the bug is
excessive!)
