Well! Its the problem created by the title used by the person who reported the speech at Ars Technica. I was at the Linuxcon and present during the speech where Eben got a standing ovation by the hacker community. All he said was that , in the United States, we should stop expecting the Judiciary (SCOTUS) will help clarify the mess created for Software Patents nor can Patent Reform at the Congress level will help bring the result desired by our community. Thus, at least in this part of the world we need to devise other ways such as extensive use of re-examination, steps taken by entities like OIN, creation of Prior Art pools etc to tackle the problem. Nowhere did he imply that we abandon the war or our opposition.
This is in the same light as the argument which was earlier put on this mailing list w.r.t . opposition filing in India. By changing the weapons and mode of our battle we are not giving up on the war.
