When the next Amendment is proposed, we should vigorously push for the removal of the "per se" clause. However, the next Amendment may be a few years away. In the interim, the oppositions is the most pragmatic and practical thing we can do to change the game. If we can invalidate a bunch of patents and demonstrate how this "per se" clause is used to defeat the will of the Indian parliament, it makes our case much stronger when the next Amendment comes along.
