Actually it is lgpl. But uses a patent encumbered compression/decompression 
format. Since India does not recognise software patents, it may not be an 
immediate concern. However given that VP5 with ogg/theora is the open 
unencumbered standard, it is definetly better to use that from the start. 
There is a downside to this though. As long as you are conferencing within a 
close group having the same setup, there is no problem. If you have to do a 
conference with some other vendor equipment, you will be in trouble without 
h263/h264. Afaik none of the commercial equipment have VP5 (or higher) 
ogg/theora. So essentially they are flogging a dead horse.
