This is the patent part. Any code using the tech would have to be GPLV3 or 
later. GPLV2 dose not cover the corner case of software patents. Thus a gplv2 
licenced code cannot be distributed in a country which recognizes software 
patents. 

Linus was objecting to V3 as he felt that this was specific to the US and was 
an unnecessary administrative burden in switching v2 code to v3.

In hind sight Linus was only partly right. As usual RMS was spot on with this 
one too. While the US is fully screwed with patent wars, EU is not exactly 
free of the mess.
