The poor guy working at WalMart for next to no money simply is just mouthing was the sales pitch is and just doesn't know any better. He's not trying to mislead anyone, WalMart is.

Sounds like he's just mouthing the press release.
I checked out one of their free downloads. It's WMA CBR 128. Trying to understand the difference between Ogg, WMA, MP3, MP3 LAME, MP3 Pro, 64bit, 128 bit, 192 bit, CBR, VBR is daunting for most consumers and front-line retail staff. Most people just don't know the difference and shouldn't have to.
WalMart, on the other hand, knows exactly what it's selling and it's too bad they're selling 128 CBR. "CD-Quality" it ain't.

Wallmart definition:
What does CD-quality mean?
CD-quality means that the sound quality of the music downloads you buy are of similar quality as those you would get on a physical CD. When you play your music or burn it to a CD, you will get great sound quality that is similar to the quality of the physical CD.
Nice and vague isn't it.... :-)
Here is another:
What file format do Music Downloads come in?
Music Downloads from Walmart.com are 128-bit WMA files. The WMA format allows record companies to protect their music by using Digital Rights Management (DRM) encryption. This means that music downloads are legal, safe, and easy to use. The 128-bit WMA files also offer superior sound quality.
Windows only DRM... sad, but probably a requirement from the record companies.
