It is a smokescreen to "scare" everybody (snicker) and also an obscenely blatant posture posed to gain sympathy for their "case". If the DOJ hadn't been bought off by Republican lobbying by M$, (they spent 24 million on the republicans, btw) it's entirely probable that they would have been broken up by now. There have been three judges on this case; and in every case, Microsoft (through its MSNBC news services and other means) have been able to push the view that these judges were biased. This trend is unparalleled as far as I know.
