AFAIK the protocol version is only set to 'null' if the layer contains no downloaded data. If you did not copy any existing data (not a single node/way/relation) from a dowloaded layer to the layer you saved, then the file only contains new objects.
New objects have no version tag, neither in v5 nor in v6. In that case, (and only that case,) it would be safe to just change the protocol version to '0.6' and upload the new data.
