I agree with you but the NCC pathways have been brought in from either CANVEC or yahoo imagery by others. The cycle lanes on roads have been mapped by direct observation, as have the paved_shoulders ie existing roads noted and tagged so these aren't a problem.
Some cycle paths through city parks have been added in the past I assume from GPS traces looking at the GPS traces available and also from CANVEC and some are tagged Yahoo imagery. I need to clarify with the city how to determine which and if the city paths in parks / paths anyway are officially open to cyclists. They are doing a licensing review currently so that should help on the licensing side. The signed cycle roads aren't a problem, the unsigned roads currently are a problem but these can be left off the OSM map.
