The GPL is a license, and as such only the owner of copyright can release 
code under a particular license. If you don't have copyright, you can't 
release code under the GPL.

If it were discovered that there was some GPL code in Windows, then 
anybody who distributed Windows without distributing the source code would 
be infringing copyright (distributing the GPL code without permission).
