Time Running Out

coming before the Supreme Court later this year. As you'll also read below,
the President's political advisers appear to be winning the argument in
favor of staying out of this very important fight.

It's Not the "Diversity Protection Clause"

"Is the goal of diversity enough of a 'compelling interest' to override the
Equal Protection Clause of the 14th Amendment? Certainly most Americans
don't think so. In a nationwide poll reported last year in The Washington
Post, respondents overwhelmingly opposed racial preferences. That view cut
across all groups: 86 percent of blacks, 94 percent of whites, 88 percent of
Hispanics, and 84 percent of Asians agreed that college admissions (as well
as hiring and contracting) 'should be based strictly on merit and
qualifications other than race or ethnicity.'

"Americans have internalized Martin Luther King's foremost teaching -- that
human beings should be judged by the content of their character, not the
color of their skin. They understand that real diversity encompasses 'points
of view, backgrounds, and experiences,' as (Justice Lewis) Powell put it in
(the Supreme Court's) Bakke (decision). They know that race is no proxy for
those qualities, and that a state university that claims otherwise engages
in just the kind of racial stereotyping that the 14th Amendment condemns.

"...A double standard in admissions -- one for whites and Asians, a much
lower one for blacks and Hispanics -- is no way to foster respect and
tolerance. It victimizes those who apply to college and get rejected in
favor of less qualified applicants. It feeds the belief that black students
are not as bright as everyone else on campus. It fosters hypocrisy on the
part of college officials. It undermines black achievement by conditioning
black students to think that they can enjoy the fruits of excellence without
doing excellent work. It is, in the end, institutionalized condescension,
and the longer it persists, the more lasting harm it does.

"The phony 'diversity' of the racial bean-counters is corrosive and
dishonest. It stigmatizes its supposed beneficiaries and sends the ugly
message that what matters most about us is the color of our skin. If
anything is an affront to the Constitution and to human dignity, race quotas
and preferences are. The Supreme Court cannot say so soon enough."

White House Still on Fence Over Race Case

"The White House yesterday denied that its hesitation to join a Supreme
Court battle over affirmative action was connected to lingering raw feelings
from last month's racial flap over Sen. Trent Lott. Presidential spokesman
Ari Fleischer, in response to an article in The Washington Times yesterday,
said President Bush was taking a 'wait and see' approach because he wants to
weigh the case on its merits.


"White student applicants are trying to overturn the University of
Michigan's preferential treatment of black and Hispanic applicants. . . .
The Justice Department has already sent the White House a brief backing the
white students, who object to the school's practice of automatically giving
minorities 20 points on a 150-point admissions scale.

"Mr. Bush has until Thursday to decide whether to endorse the Justice
opinion by sending an amicus brief to the Supreme Court on behalf of the
white students. . . . White House officials have been leaning against
weighing in on the racially charged case, although they could change their
minds before the deadline.

"...Liberals are expected to redouble their accusations of Republican racism
if Mr. Bush sides with the white students in the Michigan case. The White
House appeared mindful of political fallout from such a scenario."

Former Ed Secretary Says No to Affirmative Action

"Former Education Secretary William J. Bennett yesterday urged President
Bush to file a Supreme Court brief supporting white students who claim the
University of Michigan affirmative-action plan blocked their admission.

" 'By maintaining separate systems of admission - dependent on skin color -
we are turning a moral policy of color-blindness and equality into a
perverse system of numeric equality, converting the theme of racial
unconsciousness into a policy of racial consciousness,' Mr. Bennett said in
a broadside that called on fellow Republicans to craft a new civil-rights
agenda.

".'If we as a nation truly want to get beyond the idea that skin color is
less important than merit and character we need simply to end race-based
policies against everyone. Admissions and jobs should not be set aside for
whites, nor should they be set aside for blacks,' Mr. Bennett said."

Time to Stand & Deliver

"The White House, ignoring George W.'s campaign tough talk, has decided to
take a pass on the affirmative-action lawsuit at the University of Michigan.
Or maybe not. Karl Rove still has a week to decide.

"...Before 'the Lott mess' erupted in Washington...the idea that this
president would cave on affirmative action seemed far-fetched. Not now. . .
. Several White House sources insist that the decision has already been
made, that Karl Rove calculates that the president can escape the wrath of
both right and left by getting out of Dodge.

"...This time George W. has to be the man of conviction his friends imagined
they elected in the year 2000. He has to tell his political consultants to
shut up and leave the room if they can't take the heat. . . . Voters
sometimes let themselves be manipulated. But sometimes they won't. The
constituents George W. must count on when the going gets tough regard ending
affirmative action, restricting abortion and cutting taxes as the very
reasons they worked to get him elected."

Habla Espanol?

Thanks to the tree huggers, 300 jobs were lost in tiny Libby, Montana last
October when Stimson Lumber Company was forced to close its mill. At around
the same time the EPA (Environmental Protection Agency) began advertising
200-300 new jobs "to address asbestos contamination of Libby's homes and
buildings." In addition, the Forest Service was expected to bump up its
staffing there by some 100 new employees.

Alas, the laid-off folks from the Stimson shut-down couldn't benefit from
the fed's hiring bonanza. Indeed, men and women who applied for the EPA jobs
were turned away as "unqualified." Why? Because the EPA only wanted
bilingual employees. According to the Mountain States Legal Foundation, "One
local quipped that the only truly qualified individual (in Libby) was the
high school Spanish teacher and he already had a job."

Why the discrimination by the feds against English-speaking Americans? Well
it seems that just days before the Stimson shut-down, the Forest Service
settled a lawsuit and agreed to "increase the number of Latino Forest
Service employees." I think you can now connect the dots.

This sort of discrimination based on race, not merit, can be ended with a
favorable Supreme Court ruling in the upcoming case involving racial
preferences at the University of Michigan. Unfortunately, President Bush may
not weigh in on this important case for fear of upsetting minorities the
White House hopes to attract for the 2004 elections. He has until January 16
to decided whether or not to allow the Justice Department to file a brief
opposing racial preferences with the Court.
