So far I can't find anything even remotely close to a proper EULA. The "Accept this License" dialog box in 3.0 and 3.0 SP1 gives me this:
"MICROSOFT WINDOWS SERVER UPDATE SERVICES 3.0 SERVICE PACK 1 PLEASE NOTE: Microsoft Corporation (or based on where you live, one of its affiliates) licenses this supplement to you. You may use it with each validly licensed copy of Microsoft Windows Server software (the “software”). You may not use the supplement if you do not have a license for the software. The license terms for the software apply to your use of this supplement. To read the license terms, go to www.microsoft.com. Microsoft provides support services for the supplement as described at www.support.microsoft.com/common/international.aspx." The EULA download at the WSUS 3.0 SP1 download site provides you with some RTF files that says the above in 18 different languages. I also found this text at http://www.wsuswiki.com/WSUSFAQ, which helps shed some light on things: "Q. Is WSUS free? A. Yes, WSUS is a no-cost download from Microsoft. However, you must have a valid Windows Server 2003 license for the WSUS server itself, as well as Windows Client Access Licenses (CALs) for each machine updated by WSUS. This is an important consideration for organizations that run Windows desktop operating systems, but non-Windows server operating systems such as Novell or Linux. Additionally, if you decide against the free MSDE/WMSDE database and instead use SQL Server 2000, you also need SQL licenses (either per-processor, or CALs for each WSUS-managed computer).
