We combat that problem by using double opt-in (confirmed consent) and then
we store the source of the sign up (web form, sweepstakes entry, etc) along
with the date and include that in every email we send.

So it'll say something like "Andy Ognenoff, you subscribed on 5/26/09 as
andyognenoff[at]gmail.com through our win a cruise sweepstakes."  And then
of course you provide a one-click unsubscribe as well.

Big problem is with people that consent to receive the email, sign up for
the newsletter, put their address in the fields ( hand-written or digital )
then later complain that we are sending them marketing emails .,
