I doubt that will hold up in court, and shows 'negligence' ... like someone committing a crime with your gun, that you didn't lock up and someone 'borrowed' because your negligence made it available to assist in the crime ... I'm not a lawyer, but that's my thinking ..

Another good reason for setting up security (WPA2, WPA, even WEP ) just to keep random war-drivers off your network.
