We do still have concerns about workload and resourcing as outlined in previous messages, but recognise that practices who are planning to participate want support with doing so in the safest way possible for them, so this message focuses on implementation advice. Our PCN schedules document has been updated as follows: 1. The Lead Practice The Lead Practice enters into this agreement for itself and with the full authority of the remaining PCN Member practices who hereby agree that the Lead Practice shall be their authorised agent and shall, via their agent, be legally bound to the terms and conditions of the agreement. (This is included under Schedule 4 and highlighted green). The revised wording in the schedule creates an authority for the Lead Practice to act on behalf of the other practices in the PCN and more importantly to bind them to any agreement or arrangement that the Lead Practice enters into on behalf of the PCN as a whole. This means that even though practices do not sign individually they are still bound legally to the terms. The lead practice is acting as agent for the other PCN members and therefore, as agent, binds legally the others as well as itself. 2. Associate Member For the avoidance of doubt no Associated Member of the PCN shall have any power or authority to vote at any PCN Overseeing Group and shall only be an associate member for the purposes of any subcontracting arrangements under a formal written agreement. (This is set put under Schedule 2, clause 1.v and highlighted green). The revised wording has been amended to support PCNs who may wish to use the services of another provider i.e GP federation who are non-core members of a PCN. 3. Transitional Arrangements - Practices signing the ES, commencing in June 2023. We understand it is the commissioner's wish for PCNs and practices to have signed the contract by 31 March 2023 with scope for PCNs to transition to delivery by June 2023 subject to approval of transition plans. Practices may wish to caveat signatures to the contract on 31 March 2023 where transitional plans are being developed and the following wording has been provided. 'This document is signed subject to each practice within the PCN undergoing its own due diligence and capability, in respect of delivering under this contract, confirmation of which shall be delivered to the commissioner at least two weeks prior to the commencement of the service or services'.
