Usually the FCC just limits total transmission dB and not the specifics of
any antenna used.  That seems fair to me.  They want to regulate the
spectrum so they do it with measurements of the breadth and intensity of the
spectrum rather than the specifics of the antenna you used.  Who cares what
it looks like.
