This isn't entirely clear. If you are just looking at the radio signal, then Dustin is 100% correct. However, assembling the radio signal into human readable information, that can be considered private, without their permission _might_ be illegal. There's a difference between seeing radio signals and reading someone else's emails. This may be analogous to seeing someone else's closed letters on their doorstep, and opening them up to see what's inside.

Now, I'll also say that I think that it is stupid to have this false protection under the law, since you should be securing your communications.
