See "United States" section. There are charges and convictions.

Interesting indeed. I had always assumed that this was a case of either
disinterest by the legislators, or the law not keeping up with the
times. Kind of when Ecstasy was legal before designer-drug laws came on
line.
So, it seems that the practice is either fully legal or de-facto legal
in much of the country (depending on specific state statutes, etc etc).
