Case
92320: An unleashed dog knocks a
cyclist into a ditch.
A dog "escaped" from
the owners "leash" in Minnesota and went after a cyclist. The cyclist went
down, and wanted to recover his out of pocket expenses from the dog owner.
When he came back with a final sum of around $1200 they didn't want to pay so he
took them to court asking for $3000 total to cover the
ordeal.
In defense, the dog
owners said that (1) there are lots of bike trails in Minnesota he could have
been on, (2) the dog, (known to go after bikes) just riggled out of his collar
(3) he should not have been cycling 30-40mi from his house (4) the roads and
higways are busy in their neighbourhood.
The judge awarded
$3000 to the cyclist.
