Brian I don't see the problem here - or perhaps I do not understand it. Seems to me the magistrate won fair and square or did he. Its all a bit confusing appellant and plaintiff and defendant. 1. Magistrate illegaly arrested twice 2. Wins his case and R28000 3. The state or police appeal and the award is reduced to 15000 4. The appellant (the state or the police) has to pay cost of case (including their 2 retained counsels) SO justice prevailed but the state wasted time and money (they seemed to save some on appeal but no mention were made how much their lawyers cost)? Or the police are at fault and wasted tax payers money? or Both? I am still confused.
