Do you have a solution for variations on the disturbance theme?

33 South Backpackers at 48 Trill Road (the orange house), installed intrusively 
bright florescent signage on the pavement in October. Half my flat is robbed of 
darkness and many other flats are affected by this rude flood lighting.

I called the police the day these lights went up and was told to keep reporting 
the problem. We at Churchill Mansions have had meetings with Natasha and her 
staff about noise and these lights. The noise hasn’t been bad over the 
Christmas holidays, but the lights shine relentlessly until someone remembers 
to turn them off after sunrise.

I’m itching to do some target practice from my balcony which is less than a 
stone’s throw from these fittings.

Have you got a better idea?

Where do you live? Are you renting or are you an owner? Are the people upstairs 
renting? Do you know who the landlord is?
What times of the day are they playing music?
Can you keep a time log of exactly when they are playing music, and then note 
down when you go and speak to them to ask them to turn it down, and what their 
response is.
If you can do this for a couple of weeks then you are in a better position to 
make a complaint to the authorities.

The City of Cape Town has by laws which stipulate times where noise over a 
certain level is not acceptable, and a legitimate basis for complaint can be 
lodged with the authorities.
 

 
Firstly, check the by laws and times one can expect “peace and quiet”.
 

 
Secondly, speak to your neighbour.
 

 
Thirdly, are you a property owner, or tenant, and what of the offender? Do they 
have a landlord you can approach?
 

 
Logging the times are pointless if they fall outside the hours when noise is 
permissible, but if the noise is unreasonable after 10.00 pm in the weekdays, 
and 12.00 midnight over the weekends, then you have a case. Just check those 
hours as well, that was the law the last time I checked up and I don’t know if 
there have been and changes since.

I skimmed through the regulation as usual a lot of blah blah blah. But
no mention of times. Clearly amplified music that disturbs is listed,
but not wailing of clerics and ringing of church bells. Disturbing
the peace for you religion is obviously tolerated and allowed tacitly
or implicitly.
 
Barbara do you have links to by laws that specify times.
 
A noise louder than specified in regulations is not allowed at any
time unless specific permission has been obtained - thats what I took
from that legislation.
 
It seems keeping a log is critical.
 
Good luck to the OP.
 
I don;t think this is an issue for the municipality and I doubt much
joy without an appalling waste of time will be obtained. Perhaps
earplugs and sleeping tablets or a good joint is the way to go.

Hence my second point refers. Speak to the neighbour thus relying on mutual 
respect. Rather than earplugs and a joint as you have suggested.
 
I hardly think recommending use of illegal substances is appropriate when 
muchbof our crime in Obz is drug related.

Glad you having support from Obs stalwarts thus far. Carolyn's advice is a
good way forward.
 
If noise persist, SAPS can be contacted to tone them down a few times.
Note down your date/time when calling on them, and results etc.
 
If ongoing, Metro Law Enforcement can be called, or asked via OBSID/OPS, to
address them, else the local Obs Metro Law Enforcement Reservist to be
contacted - they can issue fines etc. Also note date/time logs etc.
 
I hope your matter is resolved peacefully and quickly.

Henk is most experienced on this issue.
As far as I recall, he told us that we can complain whenever we are disturbed 
by noise that is disruptive when we are in our homes with doors and windows 
closed.
It is particularly legitimate if the disturbance is on-going.
You do not need to wait before you complain. Just keep a record so there is 
evidence so the problem is well tracked for evidence, particularly after each 
time the neighbours have been warned.
One can even ask OBSID to speak to the neighbours and ask for advice who to 
call from Henk or councillor Patrick Chapple.
I do not think it matters if you are an owner or not but you certainly can deal 
with it through a land lord if the problem is caused by people who are renting.
 
I believe in speaking to people nicely and telling them that you are disturbed 
by the noise and if they could please tone it down.
If you have complained and they have not responded, you need to take firm 
action, calling the police if necessary, explaining the problem and then you 
have that evidence also when, if it persists, you can lay a charge of 
disturbing the peace and it would be best not to confront them too often, 
opening yourself up to abuse from them.
If after the problem persists and you have records of evidence, there is a fair 
chance that they can be stopped by imposition of a fine, equipment removed, or 
eviction with help of authorities. I am not sure but it is not easy to achieve.
I once resorted to using my hosepipe to wet my neighbours through their open 
window but can not recommend this action due to water restrictions and other 
reasons.

Hi Mithila,
 
You have my sympathies, as part of activists fighting the noise and other
problems emanating from the clubs and pubs for many years we became very
much aware of what noise disturbance can do to residents.
 
Yours however seems to be a disturbance from private individuals but the
same principles and human rights apply.
 
1. Talk to the offending parties and try to get to some working
relationship.
2. Phone *10111 and tell them that you have a noise complaint providing the
number and street from which the noise is coming
3. Record date and times when noise started etc but also ask for I.R.
reference number and name of operator.
4. 10111 should send a radio signal to Woodstock SAPS who must attend to
the matter.
5. You can make a complaint say every 20 to 30 minutes.
6. Keep a record of all complaint, names, references etc etc. (very
important).
 
* Alternative Saps and Law Enforcement numbers you will find on
obs.org.za/obsdir/ download and book mark it to your phone it gives a
listing of over 50 Obs Emergency numbers and whilst there have a look at *Noise
Clubs & Pubs & the Procedure.*
 
Whilst this could help it may not be the end of it and that's were the
records come in.
