Several Answers.

1. Who cares - you still have to write the software and who is to say that it 
is an exact implementation of the IP?
2. You have to own it - else you will end up in a nightmare later on - esp. if 
it forms part of an existing product.
3. If it is ground breaking and can be isolated to a separate module, and will 
never effect your core product, then perhaps the case could be different - but 
then would almost guaranteed to cost more $ as a result.


All our contracts are quite specific about this - and this is a common issue 
and occurrence for us - i.e. our clients are always paying for enhancements and 
we always own the resulting software.

But then we don't exactly operate in the area of ground breaking research.

the software house and pays for that work then who owns the IP of the
