Several Answers. 1. Who cares - you still have to write the software and who is to say that it is an exact implementation of the IP? 2. You have to own it - else you will end up in a nightmare later on - esp. if it forms part of an existing product. 3. If it is ground breaking and can be isolated to a separate module, and will never effect your core product, then perhaps the case could be different - but then would almost guaranteed to cost more $ as a result.
All our contracts are quite specific about this - and this is a common issue and occurrence for us - i.e. our clients are always paying for enhancements and we always own the resulting software. But then we don't exactly operate in the area of ground breaking research.
