In my personal view, it's "we are a commercially sponsored open source project and current legal realities require our sponsor to do whatever they can to protect themselves and our project." If you feel it is a barrier for your personal contributions, then please use the appropriate channel of communication [1]. It has been my experience that they will work with you to address whatever concerns you have as best they can.
