It looks like some similar discussions are going in parallel over on the
ogf-l. OGL doesnt have specific restrictions to software and it is clear it
didnt take software or "broadcast" into account.

Under the d20 Trademark Licence draft, there are restrictions on character
generation. Yet under OGL, many of the components of character generation
are considered "Product Identity" under OGL. If d20 SRD is being released
under OGL, and it appears by definition of OGL that Product Identity can
remain the property of the author, why does d20 Trademark License exclude
character generation?
