Plenty of others have answered your question. I'd like to address a second
matter.

As of now, I believe THERE IS NO GENTLEPERSON'S AGREEMENT. That agreement
was an understanding between gentlepersons that if you used material in the
draft SRD that had not been released, and if you used that material under
the OGL in a proper fashion as if it had been released, the Wizards would
not take action for what might arguably be seen as unlicensed use of their
material. In return, you would take necessary and reasonable corrective
actions to bring your material into compliance with the released version of
that material when it finally came out.

But as of now, there is no more draft SRD material. It has all been
released. Furthermore, Wizards has announced that in the future, they will
not be using the draft mechanism (which was always just a stopgap measure),
but will instead be releasing OGC only in released form (and as best they
are able, close to the release date of any corresponding closed content,
though they're making no promises).

So from this point forward, I believe the Gentleperson's Agreement is no
longer in effect. The only exception I can imagine is that publishers who
have older, non-compliant materials still are expected to take reasonable
measures to bring it into compliance.

(I also believe that, like the OGL and software, the Gentleperson's
Agreement is a topic that will keep coming up for a long time to come...)
