Given the crudely replaced section of 'whire box' D&D rules where
'hafling' was pased in over 'hobbit', I don't think JRR was all that
generous. :)
Vance, OTOH, could have raised a stink -- IOUN stones and "prismatic
spray", for example, are explicit copies of terms, not just an idea
swipe.
Still, I shall argue there's an ethical difference between benign
neglect and actively stating "We permit you to use our trademarks, over
and above your rights under the law", which is what the current WOTC
policy is.
