People, take a breath. IANAL, but even I can see how this works.
The OGL is copyright WotC (I'd rather it be copyright Ryan Dancy, or the
OGF, but WotC is as good as any.) That does *NOT* meant that it cannot
be used as intended--permission to copy it is implicitly granted by
requiring its distrubtion, as you HAVE to be able to distribute it when
you follow its terms.
What you CANNOT do is distribute it, or modify it, or make a derivitive
work based on it without special permission. Thus, OGL means the OGL,
and not how you hacked the OGL for your own gain.
IIRC, the GPL is copyrighted for the EXACT same reason.

P.S. Ryan, what ever happened to the OGF being an indipendant
organzation?
