Maybe I'm just terminally confused, but I assumed that Product Identity was
things like "D&D", "Vampire", "Ogre GEV", "The Computer is Your Friend!", etc.
IOW, stuff you would probably be trademarking anyway because it is, after all,
your *product identity*.
So you print a brief note at the beginning of the game saying that "the following
terms and phrases should be considered our product identity" and then go from
there.
If someone goes in and decides to just start identifying random phrases, words,
or whatever as product identity then they're only hurting themselves (under the
OGL model), because it will be a major discouragement from others
using/referencing their material and (therefore) building their network worth.
