Isn't that part of the point of the OGL? "We will give you free use of
this text, and, in return, you waive certain of your rights." The GNU
GPL does the same, albeit more on copyright than on trademark. All open
licenses -- as opposed to just placing things in the public domain --
grant rights in exchange for compelling or limiting behavior.
