OK, new topic.

Bouncing around in my head has been the idea of an "open trademark license." 
  This would let someone make their open gaming project "completly" open 
without making their name useless.

In a nutshell, it would let someone use the original trademark if it met 
certain broad qualifications, that the original contributor could set.  For 
example, "Linux games" could let anyone use the trademark "Linux" but only 
so long as they identify themselves as different somehow (i.e., "Forgotten 
Linux", "Star Linux") and use all of the core "Linux" rules.

Or, for example, Wizards could use this an let anyone use the "d20" 
trademark as long as they follow the guidelines of the d20 Guide.
