Side point: I have little doubt that a court would rule that the Q&A is for
most purposes legally binding. It's attached (by the drafter) to the document,
and it's highly foreseeable that the reasonable reader of the OGL will use the
information provided in the Q&A to inform their understanding of the agreed
terms. Absent a merger clause - which the OGL doesn't have for some reason -
it's (IMO) clearly admissible evidence on the terms actually agreed to by the
parties.
