Good question. Remember "mixed works?"
It would be *easiest* to say "no, they can't." It would be *best* to say
"Sure they can."
A good compromise might be to extend the "names" rule to "trademarks." If
someone claims their graphic as a trademark, then it can be excluded. if
not, well, then they have to leave it OGC.
