Possibly.  You might run into platform and install issues though.  If you
included all the OGC in a text file that the program checks for before it
will run (to be absolutely sure the program isn't being distributed without
complying) that would probably be good.

No, definitely not.  It has to be included with the product.  If that were
the case no one would have to indicate Open Content, they'd just say
"everything included in the SRD available at X website is Open."
