this is yet another case where i think the WOGL is woefully unclear.
"means" is a poor choice of verb, because it can both be definitional
and indicative. while i have read the PI definition as clearly
excluding game mechanics, i thought it was perfectly clear that,
provided your game mechanics were not derivative of game mechanics
already released as OGC, you could choose whether or not to make them
OGC. it looks to me like many of the existing D20 products have a
mixture of OGC and closed content in their mechanics--i guess we
won't know which way this clause is intended to be interpreted until
after the letters have been sent and the corrections made (or not, of
course).
