In my opinion, *all* new game rules should be OGC.  You write a new 
feat, that's OGC.  If you make a new PrC, it's stat block (comparable to 
the info of the classes in the SRD) is OGC.

Of course, this is just my opinion of what the right thing to do.  The 
law lets you do less, just as it lets you do many other wrong and 
not-right things. (like, to name one, lie.)
