They aren't "100% OGC", they are labelled "the text presented herein is open 
content".

"Text", not art.

Also, whether it is "illustrative" or not doesn't make it derivative.  
Further (in this case) whether the artwork is derivative of the text has 
nothing to do with whether it is "open", since the artwork was obviously 
commissioned before the text was "opened".
