I dont want to disagree with Ryan, but I would not say that a description such as an octopus headed guy by you would violate the license. all the elements are there--tentacles around mouth, etc., in teh SRD description. That is a tough position for WotC, IMHO, say you cant describe the mind flayer as above. What you cant do is say Illithid or use the specific planescape material background.
