WOTC can make any exceptions it feels like, completely ignoring the OGL. 
When you are talking about their stuff (ie: the SRD) they are not 
constrained by any license that someone like us would be. They want Dragon 
to use everything....they say "use everything". They want to give KenzerCo 
the OK to publish all their rules with the d20 logo...they say "go for it." 
The OGL does not preclude the creation of independent agreements...it 
simply offers a blanket agreement that allows other developers to use the 
SRD without asking first.
