No, that's just not true. WotC has to follow all of the conventions of the OGL just like everyone else. Otherwise they could go snitching anyone's work and putting it into their own stuff as closed content.
You're thinking of the D20 STL.. WotC can do anything they want with the D20 Logo. In terms of the MM2, the terms of the agreement aren't out for public scrutiny, but the impression I got was that WotC has licensed the use of those CC monsters from White-Wolf. As such, they don't really _need_ to use the OGL since there is a Hypothetical Pre-OGL version of those Monsters that White-Wolf can license out as the creators. As to why WotC even bothered to use the OGL for those monsters, it was probably part of the Licensing Agreement or they figured the stats were already open and so why not just leave the license attached. A 3rd more complicated option would be that the monster stats were derivative originally of the SRD while the name and any description were not. Because those stats were already derivative then the OGL had to be brought along with the stats anyway. But since the other stuff wasn't derivative really, it was just bought with a separate license which didn't require the updating of section 15 to include anything but the specifically derivative bit which came back from the SRD. When reusing OGC from another source, you MUST update Section 15 in your product to reflect that.
